These Terms & Conditions (hereinafter referred to as the "Agreement" or "Terms") constitute a legally binding agreement between Ascensify Technologies (hereinafter referred to as "Ascensify", "Company", "we", "us", or "our"), headquartered in Kolhapur, Maharashtra, India, and the entity or individual (hereinafter referred to as "Client", "Customer", "you", or "your") accessing our website (https://www.ascensify.com), commissioning technical services, or executing transactions via our payment interfaces.
By browsing this website, requesting a proposal, approving a Statement of Work (SOW), issuing a purchase order, or submitting payment via our digital checkout gateways, you acknowledge that you have read, understood, and unconditionally agreed to be bound by all terms, policies, and notices set forth herein.
Eligibility: You represent and warrant that you possess the full legal capacity and corporate authority to enter into this Agreement on behalf of yourself or the business entity you represent.
Ascensify Technologies provides high-performance custom software engineering, cloud architecture, mobile applications, and artificial intelligence solutions. Our core service capabilities include, but are not limited to:
- Custom Software Development: Scalable enterprise backends, RESTful and GraphQL APIs, microservices architecture, and database engineering.
- Mobile Application Engineering: Native and cross-platform mobile apps for iOS (Swift) and Android (Kotlin / React Native / Flutter).
- AI & Machine Learning Solutions: Predictive intelligence, fine-tuned LLM agents, Retrieval-Augmented Generation (RAG) pipelines, and computer vision systems.
- Web Application Development: High-speed web applications engineered using Next.js, React, TypeScript, Node.js, and modern headless architectures.
- Cloud Architecture & DevOps: AWS, Google Cloud, and Kubernetes deployments, automated CI/CD pipelines, containerization, and 24/7 infrastructure observability.
- Enterprise ERP & CRM Solutions: Customized workflow automation, internal tools, ERP systems, and supply-chain dashboards.
- UI/UX Design & Prototyping: Design systems, Figma interactive prototypes, user journey mapping, and design-to-code implementations.
- IT Consulting & Managed Support: Technical audits, code reviews, SLA-backed maintenance, server monitoring, and legacy system modernization.
Every commercial engagement is governed by a detailed Statement of Work ("SOW"), formal proposal, or sprint backlog agreed upon in writing between the Client and Ascensify.
- Scope Definition: The SOW shall delineate specific technical deliverables, milestones, tech stacks, acceptance criteria, estimated timelines, and commercial consideration.
- Change Requests: Any requested addition, modification, or expansion of project scope beyond the agreed SOW shall be evaluated via a formal Change Request (CR) document, detailing impact on cost and schedule. Development on change requests shall commence only upon mutual written approval and receipt of associated milestone payments.
Ascensify Technologies integrates secure digital payment mechanisms to facilitate seamless domestic and global commercial settlements.
4.1 Payment Gateway Processing
Online transactions, invoices, and retainer payments are processed via authorized, PCI-DSS Level 1 compliant payment gateways, primarily including Razorpay and Stripe. By initiating payment, you authorize our gateway partners to securely process your chosen payment method.
Supported Payment Methods:
- Credit & Debit Cards: Visa, MasterCard, American Express, RuPay, Maestro (with 3D-Secure / OTP verification).
- UPI (Unified Payments Interface): Google Pay, PhonePe, Paytm, BHIM, and bank UPI IDs.
- Net Banking: Direct payment through 50+ major institutional Indian banks.
- Corporate Bank Wire / NEFT / RTGS / IMPS: Direct institutional account settlements.
- International SWIFT Wire & Cross-Border Cards: For overseas clients in USD ($), EUR (€), GBP (£), AUD (A$), and AED (د.إ).
🔒 Zero Card Storage Guarantee: Ascensify Technologies never stores, logs, or processes raw credit/debit card numbers, CVVs, or payment passwords on our servers. All sensitive cardholder data is securely tokenized and handled directly by RBI/PCI-DSS certified gateway servers.
4.2 Invoicing Schedule & Milestones
Unless expressly stipulated otherwise in the SOW, project payments follow structured milestone tranches:

4.3 Taxes & GST
All prices quoted in Indian Rupees (INR) for domestic clients are subject to applicable Goods and Services Tax (GST) at the prevailing statutory rate (currently 18%). For eligible international export clients, services are zero-rated for GST in accordance with Indian export of service regulations, subject to compliance documentation (FIRC / e-BRC).
4.4 Late Payments & Suspension
Invoices are payable within seven (7) calendar days of issuance. If an invoice remains unpaid after 14 days following formal notice, Ascensify reserves the right to temporarily pause active sprints, freeze staging server access, or defer production deployment until outstanding dues are settled.
All software deliverables, applications, source code, and design files provided by Ascensify Technologies are delivered exclusively through secured digital channels.
- Delivery Channels: Private Git repositories (GitHub, GitLab, Bitbucket), cloud container registries, staging servers (AWS, Vercel, GCP), compiled mobile application packages (TestFlight, Google Play Internal Track, signed APK/AAB), and Figma asset files.
- UAT Review Window: Following delivery of a milestone build, the Client shall have a standard User Acceptance Testing (UAT) window of ten (10) business days to review functionality against the SOW acceptance criteria.
- Deemed Acceptance: If the Client does not submit a written defect list within the 10-business-day UAT window, or deploys the build to a commercial live production environment, the milestone deliverable shall be deemed formally accepted.
Ascensify Technologies operates under a transparent and fair cancellation and refund policy aligned with standard software engineering practices.
6.1 Cancellation by Client
The Client may terminate an ongoing SOW by providing fourteen (14) calendar days' written notice to contact@ascensify.com. In such an event:
- The Client shall be liable only for services rendered, engineer sprint hours delivered, and third-party infrastructure expenses accrued up to the effective date of cancellation.
- If the advance deposit paid exceeds the pro-rata value of work performed, the unutilized surplus shall be refunded to the Client.
- If work completed exceeds deposits received, the Client shall promptly settle the pro-rata balance prior to final deliverable handover.
6.2 Refund Processing Timeline
Approved refunds are processed via the original payment gateway (Razorpay / Stripe / Bank Wire) within 5 to 7 banking days from the date of formal refund agreement. For complete refund terms, please consult our dedicated Refund & Cancellation Policy.
We believe in absolute client ownership of bespoke software innovations:
- Full Transfer of Bespoke Deliverables: Upon receipt of complete and final payment under an approved SOW, 100% of all intellectual property rights, copyrights, custom source code, databases, API schemas, and design files created specifically for the Client shall be assigned and transferred unconditionally to the Client.
- Pre-Existing Tools & Background IP: Ascensify retains ownership of proprietary internal boilerplate libraries, developer tooling, utility scripts, and pre-existing scaffolding used during development. Ascensify grants the Client a perpetual, worldwide, royalty-free, non-exclusive license to use, modify, and build upon any such background tooling embedded in the deliverables.
- Third-Party & Open-Source Software: Standard open-source libraries (e.g., React, Node modules, Linux distributions) remain subject to their respective open-source licenses (MIT, Apache 2.0, BSD).
Both parties agree to treat all proprietary information, trade secrets, business strategies, technical blueprints, and customer data exchanged during the engagement with strict confidentiality.
- Neither party shall disclose confidential information to any third party without prior written consent.
- Ascensify executes mutual Non-Disclosure Agreements (NDAs) prior to project kickoff upon request.
- Confidentiality obligations survive the termination or expiration of this Agreement for a period of three (3) years.
Timely delivery of software projects depends on collaborative cooperation. The Client agrees to:
- Designate a primary product owner/spoc authorized to provide technical decisions and milestone sign-offs.
- Provide necessary access credentials (cloud consoles, Git orgs, third-party API keys, domain DNS) promptly.
- Deliver required assets (branding guidelines, copy, proprietary data schemas) according to the project schedule.
Ascensify stands behind the quality and engineering integrity of our deliverables:
- 30–90 Day Bug-Fix Warranty: Following production deployment or final acceptance, Ascensify provides complimentary bug-fix support (duration specified in SOW) to rectify functional bugs or discrepancies arising from our custom code that deviate from approved SOW specifications.
- Ongoing Maintenance Plans: Post-warranty maintenance, server monitoring, security patching, library upgrades, and continuous feature roadmaps are available under customized monthly SLA maintenance retainers.
- Warranty Exclusions: Warranty does not cover defects caused by third-party API outages, unauthorized modifications to source code by third parties, hosting environment failures outside Ascensify's control, or operating system / browser deprecations occurring after launch.
To the maximum extent permitted under applicable law:
- Liability Cap: In no event shall Ascensify Technologies' aggregate liability arising out of or related to this Agreement exceed the total fees actually paid by the Client to Ascensify under the specific SOW giving rise to the claim during the preceding six (6) month period.
- Consequential Damages: Neither party shall be liable for indirect, incidental, special, punitive, or consequential damages, including loss of business profits, revenue, data, or anticipated savings.
- Force Majeure: Neither party shall be held liable for delays or failures in performance resulting from events beyond reasonable control, including natural disasters, acts of war, government embargoes, telecommunication backbone failures, or global internet outages.
Software solutions engineered by Ascensify may interface with external services, including cloud providers (AWS, Google Cloud, Microsoft Azure), payment gateways (Razorpay, Stripe), SMS/Email gateways (Twilio, SendGrid), AI providers (OpenAI, Anthropic), or application stores (Apple App Store, Google Play Store).
Ascensify does not control and is not liable for third-party service pricing changes, API deprecations, downtime, or policy shifts imposed by external service providers.
This Agreement remains in effect until all active SOWs are completed or terminated. Either party may terminate this Agreement immediately upon written notice if the other party commits a material breach and fails to cure such breach within fourteen (14) business days of written notification.
This Agreement, its interpretation, and any disputes arising out of or in connection with it shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.
Both parties agree to first attempt resolution of any dispute in good faith through executive consultation. In the event a dispute cannot be amicably settled within thirty (30) calendar days, it shall be submitted to the exclusive jurisdiction of the competent courts located in Kolhapur, Maharashtra, India.
